Massachusetts Paid Family & Medical Leave

Massachusetts passed a Paid Family and Medical Leave (MA PFML) law that provides job-protected paid time away from work that employees may take for Medical Leave for the employee's own serious health condition or Family Leave for new child bonding within 12 months of birth or placement, military exigency, or care of a seriously ill family member.

Covered Employer All private employers with one or more employees working in Massachusetts
Eligibility
  • To be eligible for unemployment benefits, the employee must have earned $5,700 during the last 4 completed calendar quarters and 30 times the weekly unemployment insurance benefit amount they would be eligible to collect.
  • Both full and part time employees are eligible for MA PFML benefits—there is no minimum hours worked requirement.
  • Eligibility is based on the amount of compensation that the employee has earned while working for any employer in Massachusetts during the last 4 completed quarters—not the specific employer. Therefore, new employees may be eligible if they previously satisfied the eligibility requirements during the requisite time period at a prior Massachusetts employer.
  • An employee continues to be eligible for benefits if the employee has been separated from employment for not more than 26 weeks at the start of the leave.
Covered Family Members

Spouse, domestic partner, child, parent, or parent of a spouse, domestic partner, or sibling of the employee.

Leave Types
  • Employee’s own serious health condition
  • Care of a seriously ill family member
  • New child bonding within 12 months of birth or placement
  • Military exigency
  • Military Caregiver
Waiting Period
  • 7 days
  • None if bonding leave immediately follows maternity medical leave
Weekly Benefit

The sum of:

  • 80% of the portion of the employee’s Average Weekly Wage (AWW) that is equal to or less than 50% of the State Average Weekly Wage (SAWW); and
  • 50% of the portion of the employee’s AWW that is greater than 50% of the SAWW.
Maximum Benefit
  • Calculated annually based on 64% of SAWW
  • SAWW 2022 = $1,694.24
  • 2022 Maximum Benefit = $1,084.31
Maximum Duration
  • Medical Leave:  Up to 20 weeks
  • Bonding, Family Leave and Military Exigency:  Up to 12 weeks
  • Military Caregiver:  Up to 26 weeks
  • Employee may not take more than 26 weeks combined in a benefit year
State Premium Rate
  • 0.68% of wages; 0.56% for medical leave and 0.12% for family leave (Employee pays 40% of medical leave premium and 100% of family leave premium).
  • Rate to be set annually by the director
Private Plan Options
  • Insured and Self-Insured. Employers can obtain exemption status from the state plan by applying through the MassTaxConnect portal for a private plan. The private plan must be equal to or better than the state mandated plan.
