Colorado voters passed a Paid Family and Medical Leave (CO PFML) insurance program where benefits will take effect January 1, 2024 for qualifying leaves. CO PFML provides paid time away from work that employees can take for qualifying medical or family leaves. The Division of Family and Medical Leave Insurance, a new department within Colorado’s Department of Labor and Employment, will administer this insurance program.

Covered Employer Any employer with ten or more employees in Colorado
Eligibility
  • Colorado employees who have worked 180 days and earned at least $2,500 in the base period
Leave Types
  • Employee’s own serious health condition
  • Bonding with a new child during the first year of birth, adoption, or foster care placement
  • Care of a family member with a serious health condition
  • Qualifying military exigency
  • Safe leave
Covered Family Members
  • Spouse or Domestic Partner, parent, child, grandparent, grandchild, and sibling
  • Any individual with whom the employee has a personal bond like a family relationship
Elimination (Waiting) Period
  • TBD
Weekly Benefit
  • If employee earns less than 50% of State Average Weekly Wage (SAWW): 90% of Average Weekly Wage (AWW)
  • If employee earns more than 50% of SAWW; the sum of:
    • 90% of SAWW; and
    • 50% of AWW that exceeds 50% of SAWW
Maximum Benefit
  • $1,100 per week
  • 90% of SAWW
Maximum Duration
  • 12 weeks combined for family and medical leave
  • Additional 4 weeks for serious health condition related to pregnancy or childbirth complications
Program Funding
  • Initial premium rate is set at 0.9% of employee wages for first 2 years of program
  • Shared even by the employer and employee
