Important Message Regarding New York Disability Insurance Claims Denied Under A Pre-Existing Condition Provision

Based on a recent New York Court of Appeals decision in Benesowitz vs. Metropolitan Life Insurance Company, 8 NY3d 661 (2007), the meaning of Section 3234 of the New York Insurance Law, which addresses pre-existing condition provisions in group and blanket disability policies, was clarified. The New York Insurance Department has confirmed the clarification that Section 3234 provides for a waiting period, rather than a bar, for coverage of disabilities due to a pre-existing condition that began within 12 months of an insured’s coverage effective date.

As a result of the Benesowitz decision, Prudential is automatically re-examining all disability claims denied based upon pre-existing conditions within the three-year period prior to June 27, 2007. This means certain insured individuals are now eligible to have their previously denied disability claims re-evaluated.

Prudential will be reaching out to all parties affected by the Benesowitz decision regarding reevaluation of denied disability claims.
